Basic information

These Business Terms and Conditions (hereinafter referred to as “TC”) govern the relations between the parties to the purchase agreement / license agreement, where on the one hand the company LAB MARK as, ID No. 25713001, VAT No. CZ25713001, with its registered office at Pod Cihelnou 532/23, 161 00 Prague 6, entered in the Commercial Register kept by the Municipal Court in Prague, Section B, Insert 56543 as the seller (hereinafter referred to as “LAB MARK” or “Seller”) and on the other hand is the buyer (hereinafter referred to as the “Buyer”).

The business conditions below apply to purchases in the online store www.labmark.cz and www.labmark.eu.


How to shop

Search for the required item either by grouping (and possibly with a filter by brand, discount, stock) or by entering a code or name in the search field. (If you are logged in, you can click on the "My Profile" icon and then on the "Order List" to view the goods ordered in your previous orders and immediately add the re-ordered item to the cart.) Clicking on the selected item will open the product detail. Select the required number or variant of the product and click on the "Add to cart" icon. Add other products to the cart in the same way - their number is displayed in the cart icon at the top right. Click on the cart icon to go to the shopping cart.

Here you can change the number of ordered pieces of the product or remove the product from the cart. To add another product, click on "Back to store", to create a binding order, click on "Continue" in the order.

In the tab "Delivery data" fill in the appropriate form - "I want to log in" (intended for already registered users), "I want to register" or "Purchase without registration".

 Required fields are marked with an asterisk. To purchase, it is necessary to fill in the company ID. After filling in the ID number, we recommend pressing "Import from ARES", which will automatically fill in some of the following fields.

If you are already registered and logged in (you can log in here or before the purchase), the form is already filled in, however you can edit it, add a note to the order and your order number (it will then appear on the invoice).

In the "Shipping and payment" tab, select the method of goods collection and payment and click on "Continue ordering".

In the "Recapitulation" tab, check the order data, or edit it in the other tabs. After clicking on "Send order", the system will automatically send an order confirmation to your e-mail address.

Don't forget to check the agreement with the terms and conditions and click on "Continue ordering".


Order Processing

Prices for goods are listed including all fees and VAT, except for the cost of delivery of goods, which are in most cases quantified before concluding and sending the order.

If the goods are sent outside the Czech Republic, the price of transport is usually calculated according to the actual event and the customer is informed about the price of transport in advance. An advance invoice is usually sent for orders outside the Czech Republic, for goods, including transport, before payment.

Available information about the goods, stock levels and prices provided by the seller are continuously updated and checked, but it is not possible to 100% rule out an error caused, for example, by data transfer, which may not always be obvious. Therefore, in exceptional cases, the seller reserves the right to reject the order due to incorrect information.

Based on supply contracts, it is not possible to supply some product groups to selected countries.

The seller will automatically confirm the received order via its e-shop system. The buyer will receive an automatic confirmation of receipt of the order by e-mail. If the seller lacks any information, or if there are any discrepancies in the order, the seller will contact the customer by email or telephone.

This confirmed order is considered acceptance of the offer in accordance with the provisions of the Civil Code, unless the buyer cancels or modifies the order in writing no later than 11 am on the next working day.

Upon request, the seller will specify the delivery date for goods that were not in stock at the time of sending the order.

The goods are delivered to the buyer by standard selected transport companies, in the form of a business package, personal collection or delivery directly to the seller is also possible, especially for goods with installation.

The delivery always includes at least a delivery note with the specification of the goods.

The delivery is considered fulfilled at the moment when the buyer confirms the receipt of the goods on the carrier's consignment note or delivery note or the seller's installation protocol.

The seller sends the tax document to the buyer in accordance with his request when sending the goods (by e-mail in a recognized format or together with the shipment in printed form or separately by post).

Other documentation such as user manual, leaflets, certificates, etc. are standardly provided in electronic form for download at www.labmark.cz; www.labmark.eu. possibly sent at the buyer's request by email.


Delivery time

• for goods that are listed as "in stock": normally within 2-3 working days, or according to the specific, but accepted by the seller, the buyer's request. If the order is processed within 11 hours, then usually the next working day

• for other goods: standard from 2 to 4 weeks from the order, depending on the nature and scope of the order (in exceptional cases, the delivery time may be longer than 4 weeks, in which case the Buyer will be informed by the Seller in time). Delivery in parts is allowed. In the case of partial orders, the Buyer is charged a handling fee (possible fee for the sub-limit order and packaging) always only for the first performance.


Shipping and packing - applies exclusively to deliveries within the Czech Republic

1.The first condition is the order of goods in a minimum volume of CZK 4,000 without VAT, at the same time it is goods that do not require a special temperature transport regime and they are not goods with excessive dimensions or weight.

2. for personal collection without a financial limit but at the same time without providing cooling inserts, polystyrene boxes, etc.

3. Freight will not be charged for residual deliveries caused by the absence of goods in stock.


b. 100 CZK without VAT - orders up to 4000 CZK without VAT for goods COVID (code 09COV33D, 09COV30D, 09COV70D, 10COV30D, 10COV31D)

c. 200 CZK without VAT - orders up to 4000 CZK without VAT for goods that do not require a special transport regime

d. 300 CZK without VAT - orders for goods requiring a special transport regime (cooling inserts, polystyrene box)

e. 500 CZK without VAT - orders for goods requiring a special transport regime (dry ice, polystyrene box)

f. according to real costs - orders for goods with excessive dimensions or weight, dangerous goods, individual imports, etc.


Shipping and packing - applies to deliveries outside the Czech Republic

The final calculation will always be confirmed in advance, depending on the specific place of delivery and quantity of goods.

Payment Terms

The buyer is obliged to take over the goods and pay for them on the due date, which is normally 14 days from the date of issue.

The seller reserves the right to request payment in advance in specific cases, especially in the case of new buyers.

If the buyer repeatedly fails to fulfill its obligation to collect and pay for the ordered goods in accordance with the established business conditions, the seller has the right to suspend or refuse to process further orders of this buyer.

The seller suspends the order if its value or its value plus the sum of unpaid invoices exceeds the credit limit set for the buyer. In this case, the buyer will be notified and an advance invoice will be sent and the goods delivered only after payment.


Complaints Procedure

Complaints about incorrectly delivered or otherwise unsatisfactory goods can be made within three working days after receipt of the goods, the seller will no longer be able to take into account later complaints. Other unsuitable goods means only quality complaints (damaged packaging, expired goods, etc.).

The buyer is obliged to immediately, but no later than three working days after receipt of the goods, notify the seller of any visible damage to the shipment caused by careless handling during transport and at the same time have this condition confirmed by the carrier.

The warranty period applies to each item. The warranty covers all obvious and hidden defects of the goods, which are not compatible with the functionality of the goods, its useful and aesthetic properties.

The seller is responsible for defects arising after receipt of the goods during the warranty period or shelf life stated on the packaging of the goods, manual, delivery note or in the attached instructions for specific goods.

The deadline for claiming hidden defects is 6 months, but the longest is given by the shelf life of goods subject to expiration.

The seller is not liable for defects caused by improper storage, interference with the structure of the product and other uses of the product than stated in the enclosed instructions for use or than usual.

The deadline for settling a complaint is set at 30 calendar days. The period begins on the day of receipt of the complaint.


Protection of personal data

The buyer agrees to the processing of the following personal data: name and surname, delivery address and billing address, identification number, tax identification number, e-mail address, telephone number. Personal data will be processed to the minimum extent necessary in accordance with the GDPR Directive.

The buyer agrees that the personal data provided by the seller will be processed and stored for the purpose of fulfilling the subject of the contract. The buyer has the right to be informed what data the seller records about him, and is entitled to change this data, or to express his disagreement in writing with their processing in accordance with the requirements of the GDPR.

The seller undertakes not to provide the buyer's personal data to third parties other than the contractual carrier for the purpose of delivery of goods.

The seller is entitled to send the buyer its own commercial message if the buyer does not actively cancel this option in accordance with the requirements of the GDPR.



The delivered goods meet the technical and legal requirements in accordance with the legislation of the Czech Republic and a Declaration of Conformity (if prescribed) has been issued for them, which is available on request.

For the purposes of these terms and conditions, the seller and the buyer mean an entrepreneur who, unlike the consumer, acts in concluding and fulfilling the contract within the scope of his business activity or within the scope of independent performance of his profession.

The buyer agrees to the use of means of communication at a distance when concluding the purchase contract.

Other matters not listed here are governed by the Civil Code (No. 89/2012 Coll.) And other legal regulations, as amended.

The contract and related issues are governed by Czech law.

These terms and conditions are effective as of January 1, 2022.
